FlappyTone — Terms of Service

Last updated: 8 September 2026

FlappyTone ("FlappyTone", "we", "us") is a voice-controlled Mandarin tone-practice game operated by Pierre Bruyninckx, an independent developer, at flappytone.com. By using FlappyTone — playing the game, creating an account, or purchasing EarlyBird access — you agree to these Terms. If you don't agree, please don't use FlappyTone.

FlappyTone is currently offered as a beta. Core features are live now, more ship over time, and things may change or break along the way.

1. The game

FlappyTone is provided as-is. It may change, break, or go away without notice. It is an independent side project, not a product with a service-level agreement. Some features are free; some require an account or paid EarlyBird access (see Section 5).

2. Accounts

  • You can play FlappyTone as a guest without an account. Your progress is stored locally in your browser and is not synced.
  • Creating an account (email + password) lets your progress save and sync across devices, and lets you appear on the leaderboard.
  • You are responsible for keeping your login credentials secure and for activity under your account. Tell us promptly if you believe your account has been accessed without permission.
  • You must provide accurate information and be legally able to enter into these Terms. FlappyTone is not directed at children under 16.
  • You can delete your account at any time by contacting us (see Section 10). We may suspend or terminate accounts that abuse the service, attempt to cheat the leaderboard, or breach these Terms.

3. Acceptable use

Don't:

  • attempt to spoof, manipulate, or automate leaderboard scores;
  • disrupt, overload, reverse-engineer, or attempt to gain unauthorised access to the service or its infrastructure;
  • scrape, extract, or redistribute the reference audio or tone-shape/corridor data (see Section 4);
  • use FlappyTone unlawfully or to infringe anyone's rights.

4. Reference audio and tone shapes

FlappyTone's word audio was recorded by Jane, a native Taiwanese Mandarin speaker, specifically for this game and used with her permission. The corridors you fly through — the tone-mark shapes in the game — are generated directly from that audio, not from generic tone templates.

That audio, and the tone-shape data derived from it, is not open content. Without prior written permission from FlappyTone, you may not:

  • download, extract, or redistribute the reference audio clips or the tone-shape/corridor data, including by scraping them from the site or its files;
  • use them in another app, game, dataset, or product, including to train or fine-tune a model;
  • republish or reuse Jane's voice recordings in any other context.

This applies whether you obtained the files by playing the game, by inspecting the site, or by any other means. To license this audio or the tone-shape data, email pierre@pierrebuilds.dev.

All other FlappyTone content, branding, and code are owned by us or our licensors and may not be copied except as permitted by law.

5. Payments, EarlyBird access, and refunds

  • EarlyBird access is a one-time purchase that unlocks the current paid features plus features as they ship during the beta, for the lifetime of the account. The EarlyBird price is an early-supporter price and may rise later; EarlyBird buyers keep their access without paying again.
  • Merchant of Record. Payments are processed by Lemon Squeezy, which acts as the merchant of record for your purchase. This means Lemon Squeezy — not FlappyTone — is the seller of record for the transaction, handles the payment, issues your invoice/receipt, and collects and remits any applicable VAT or sales tax. Your purchase is also subject to Lemon Squeezy's terms and privacy policy. We never see or store your full card details.
  • Refunds. During the beta we offer a refund on request — if EarlyBird access isn't for you, email us and we'll arrange a refund through Lemon Squeezy. Refunds are handled by Lemon Squeezy as merchant of record.
  • Beta honesty. EarlyBird is sold as a beta: some listed features are live now and others are marked as coming soon. We aim to ship the roadmap but do not guarantee any specific feature or timeline.
  • Future pricing. After the beta we may introduce other plans (for example, a subscription). Any such change will not retroactively remove access that EarlyBird buyers already paid for.

6. No warranty

FlappyTone is provided "as is" and "as available", with no guarantee that it will be available, accurate, uninterrupted, or error-free. FlappyTone is a practice aid, not a certified language-instruction or assessment tool. Use it at your own risk.

7. Limitation of liability

To the fullest extent permitted by law, FlappyTone and its operator will not be liable for any indirect, incidental, special, or consequential loss, or any loss of data or profit, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us (if any) in the 12 months before the claim. Nothing in these Terms excludes liability that cannot be excluded by law, including your mandatory rights as a consumer.

8. Changes

These Terms, and how FlappyTone is offered (including pricing and features), may change as the game changes. When we make material changes we'll update the "Last updated" date; significant changes affecting paying users will be communicated by email where reasonable. Continuing to use FlappyTone after an update means you accept the new Terms.

9. Governing law

These Terms are governed by the laws of Taiwan, without regard to conflict-of-law rules, and the courts of Taiwan have jurisdiction — except that, as a consumer, you may also benefit from mandatory protections and the courts of your own country of residence.
